Here’s a sample of some of our recent victories:

Immigration:

PETITION FILED: I-601 waiver (fraud)
RESULT: Client filed for Adjustment of Status. USCIS sent a Notice of Intent to Deny. We had to file a waiver within a short deadline. Waiver approved and Client received residency.

 

PETITION FILED: Adjustment of Status through 204(l) Relief
RESULT: Petitioner filed an I-130 for Beneficiary. Before a visa became available, the Petitioner died. We filed for 204(l) relief and USCIS reopened the case. Beneficiary is now a Lawful Permanent Resident.

 

PETITION FILED: Acquisition of Citizenship
RESULT:  Client wanted help with renewing residency due to criminal history concerns. Through an extensive investigation, we determined that the Client was a U.S. Citizen. After months of litigation, the federal government sent our Client documentary evidence of U.S. Citizenship status.

 

PETITION FILED: I-751, Petition to Remove the Conditions of Residence
RESULT: Client hired an organization to file the I-751 petition with waiver. USCIS sent a Notice of Intent to Deny. After taking over the case, we filed a new waiver and the petition was approved.

 

MOTION FILED: Motion to Vacate (PC 1016.5)
CHARGE:  Health and Safety Code 11378 – Drug sales
RESULT: Motion granted. Client can now apply for U.S. Citizenship.

 

MOTION FILED: Motion to Vacate (PC 1473.7)
CHARGE:  Penal Code 245(A)(1) – Assault with a deadly weapon
RESULT: Motion granted. Client released from ICE custody and avoided deportation.


PETITION FILED:
Adjustment of Status
RESULT: Petition approved. Client is now a Lawful Permanent Resident.


PETITION FILED:
DACA renewal (after criminal conviction)
RESULT: Filed a motion to dismiss the criminal conviction in state court. Once the motion was granted, we filed the DACA renewal. Petition approved.


PETITION FILED:
I-601A waiver (unlawful presence)
RESULT: Client hired another law firm to file the I-601A waiver. USCIS sent a Notice of Intent to Deny. We took over the case and the waiver was approved.

Criminal Defense:

MOTION FILED: Request for Misdemeanor Diversion (PC 1001.95)
CHARGE: Penal code 647(b) – solicitation
RESULT: Motion granted. Case dismissed after 18 months.

 

MOTION FILED: Pre-file investigation and letter
CHARGE: Penal Code 409 – unlawful assembly (protesting)
RESULT: No case filed.

 

MOTION FILED: Request for Misdemeanor Diversion (PC 1001.95)
CHARGES: Vehicle Code 23152(a) and 23152(b) – DUI
RESULT: Motion granted. Case dismissed after 24 months.

 

MOTION FILED:  Motion to Dismiss for Lack of Speedy Trial
CHARGES: Vehicle Code 23152(a) and 23152(b) – DUI
RESULT: Motion granted. Case dismissed.

MOTION FILED: Motion to Dismiss Pursuant to Civil Compromise
CHARGES: Vehicle Code 20002(a) – Hit and Run
RESULT: Motion granted. Case dismissed.

MOTION FILED: Motion to Dismiss Complaint (PC 1203.4)
CHARGE:  Vehicle Code 23152(b) – DUI
RESULT: Motion granted. Case Dismissed.

CHARGES: Penal Code 647.6(A)(1) – Child Molestation
RESULT: Case Rejected due to insufficient evidence.

CHARGE: Penal Code 290.013 – Failure to Register
RESULT: After months of negotiation, former defense counsel recommended taking a plea deal with significant jail time. After hiring our office, the client did not suffer a single day in-custody and avoided losing his job. 

CHARGE: Penal Code 273A(A) – Child Endangerment
RESULT: DACA recipient. Convinced the District Attorney to reduce the charge to disturbing the peace and offer diversion. After 3 months, case was dismissed. Client able to keep her DACA.

CHARGE: Penal Code 242 – Battery
RESULT: Diversion. Case dismissed after 3 months.

CHARGES: Penal Code 29805 and 30305 – Felon in possession of a firearm and ammo
RESULT: Misdemeanor with no jail time.
